Terms of Service

1. Acceptance of Terms

By accessing and using the FlyGuys website and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Service Description

FlyGuys acts as a marketplace connecting vehicle owners ("Anglers") with independent drivers ("Drivers") for the purpose of vehicle relocation services. FlyGuys is not a transportation carrier and does not transport passengers. Our service is strictly limited to the movement of empty vehicles from a designated pick-up location to a designated drop-off location.

3. User Responsibilities

By booking a shuttle, you certify that:

• You are the registered owner of the vehicle or have explicit permission from the owner to authorize its operation.
• The vehicle is currently registered, inspected, and insured in accordance with state laws.
• The vehicle is in safe operating condition (brakes, tires, steering, etc.).
• You have removed all valuable personal items from the vehicle. FlyGuys is not responsible for lost or stolen items.

4. Liability and Insurance

Vehicle Damage: While our drivers exercise the utmost care, driving on river access roads involves inherent risks (potholes, branches, gravel). FlyGuys is not liable for minor cosmetic damage (chips, scratches) or damage resulting from reasonable operation on unimproved roads, including but not limited to tire damage or suspension wear.

Accidents: In the event of a collision caused by the negligence of a Driver, the Driver's insurance policy or FlyGuys' commercial liability policy may apply. You agree to cooperate fully with any insurance investigation.

5. Cancellations and Refunds

Cancellation by User: You may cancel your booking for a full refund up to 12 hours before the scheduled launch time. Cancellations made within 12 hours may be subject to a 50% cancellation fee.

Cancellation by FlyGuys: We reserve the right to cancel any service for safety reasons (e.g., severe weather, road closures). In such cases, a full refund will be issued.

6. Limitation of Liability

To the fullest extent permitted by law, FlyGuys shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Montana, without regard to its conflict of law provisions.
